1. Introduction

Welcome to MAX H CONSULTING - FZCO ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your use of our website and consulting services. By accessing our website or engaging our services, you agree to be bound by these Terms.

MAX H CONSULTING - FZCO is a freezone company registered in Dubai, United Arab Emirates (Trade License No: 13006), providing strategy, branding, and marketing services to businesses worldwide. We are authorized to provide Educational Services, Design Services, and Management Consultancies under the Dubai Integrated Economic Zones Authority (DIEZ).

Our registered office is located at DSO-IFZA, IFZA Properties, Dubai Silicon Oasis, Dubai, UAE.

2. Services

We provide the following consulting services:

• Brand development and identity creation
• Marketing strategy and campaign development
• Digital marketing consultation
• Creative direction and content strategy

All services are provided on a consultative basis. We do not guarantee specific business outcomes or results from our recommendations.

3. Payment Terms

• Payment terms will be specified in individual service agreements
• Unless otherwise agreed, payment is due within 30 days of invoice date
• Late payments may incur additional charges as permitted by UAE law
• All fees are quoted in USD unless otherwise specified
• Refunds are handled on a case-by-case basis according to the specific service agreement

4. Intellectual Property Rights

Work Product: Upon full payment, clients will own the final deliverables created specifically for them, including logos, brand guidelines, and marketing materials.

Methodologies and Processes: MAX H CONSULTING retains ownership of all proprietary methodologies, processes, and general knowledge used in providing services.

Portfolio Use: We reserve the right to showcase completed work in our portfolio and marketing materials unless specifically agreed otherwise in writing.

5. Confidentiality

We understand the sensitive nature of business information and commit to maintaining strict confidentiality regarding:

• Business strategies and plans
• Financial information
• Trade secrets and proprietary information
• Client lists and customer information

This confidentiality obligation continues indefinitely beyond the termination of our service relationship.

6. Limitation of Liability

To the maximum extent permitted by UAE law:

• Our liability is limited to the total amount paid for services during the 12 months preceding the claim
• We are not liable for indirect, consequential, or punitive damages
• We are not responsible for outcomes resulting from the implementation of our recommendations
• Force majeure events beyond our reasonable control excuse performance delays

7. Marketing and Advertising Compliance

Our marketing recommendations and strategies comply with:

• UAE Federal Law No. 15 of 1980 on Publications and Publishing
• UAE advertising and marketing regulations
• International digital marketing best practices
• Anti-spam and email marketing guidelines

Clients are responsible for ensuring their implementation of our recommendations complies with all applicable laws in their jurisdiction.

8. Data Protection

Important Notice: MAX H CONSULTING - FZCO does not store or retain client personal data or confidential business information on our systems after project completion.

Any information shared during our working relationship is handled in accordance with UAE Federal Decree Law No. 45 of 2021 on the Protection of Personal Data and is permanently deleted upon project completion unless retention is required for legal or accounting purposes.

9. Governing Law and Jurisdiction

These Terms are governed by the laws of the United Arab Emirates. Any disputes arising from these Terms or our services will be resolved through:

• First, good faith negotiation between the parties
• If necessary, mediation through recognized UAE mediation services
• As a last resort, litigation in the competent courts of Dubai, UAE

10. Modifications

We reserve the right to update these Terms annually or as required by changes in UAE law. Updated Terms will be posted on our website with the effective date. Continued use of our services after updates constitutes acceptance of the revised Terms.
